These Terms of Service (the "Terms") govern your use of the clearpassinspections.com website and the sewer inspection services (together, the "Services") provided by ClearPass Inspections LLC ("ClearPass," "we," "us," or "our"). By booking an inspection or using this website, you agree to these Terms.
SECTION 01The Services
ClearPass provides video sewer scope inspections: a visual camera inspection of the accessible portions of a property's sewer lateral, together with a recorded video and a written report of observed conditions. Inspections are performed by or under the supervision of a licensed plumber.
An inspection is a visual assessment of accessible portions of the line as they exist at the time of inspection. Portions of a line that are blocked, submerged, collapsed, or otherwise inaccessible cannot be inspected. Pipe conditions change over time — roots grow, ground shifts, and blockages can develop after an inspection. A report describes what was observable on the inspection date; it is not a warranty, guarantee, or prediction of future performance of the line.
SECTION 02Scheduling, Access, and Authorization
- The person booking an inspection represents that they own the property or have the owner's (or the owner's agent's) authorization for us to access the property and its cleanouts or other access points.
- If no suitable access point is available or accessible at the appointment, we will tell you your options; a trip fee may apply as disclosed at booking.
- You agree to disclose known hazards at the property (aggressive animals, unsafe structures, sewage exposure, etc.).
SECTION 03Fees, Payment, and Cancellation
- Fees are stated at booking and are due upon completion of the inspection unless agreed otherwise in writing.
- You may cancel or reschedule at no charge with at least 24 hours' notice. Cancellations with less notice, or no-show appointments where we cannot access the property, may incur a cancellation or trip fee.
- Reports may be withheld until payment is received.
SECTION 04Reports and Video
- Reports and inspection video are typically delivered within 24 hours of the inspection.
- The report is prepared for the client who ordered the inspection, for use in connection with that property. You may share it with your real estate agent, lender, attorney, or transaction parties.
- Reports reflect the professional opinion of the inspector based on what was visible. They are not engineering evaluations, code-compliance certifications, or repair quotes.
- We retain copies of reports and video for our records and quality purposes as described in our Privacy Policy.
SECTION 05Not a Warranty; No Guarantee
TO THE MAXIMUM EXTENT PERMITTED BY LAW: THE SERVICES AND REPORTS ARE PROVIDED "AS IS." WE MAKE NO WARRANTY, EXPRESS OR IMPLIED, ABOUT THE CURRENT OR FUTURE CONDITION OF ANY SEWER LINE, AND WE DO NOT GUARANTEE THAT AN INSPECTION WILL IDENTIFY EVERY DEFECT, INCLUDING DEFECTS IN INACCESSIBLE OR OBSCURED PORTIONS OF THE LINE. NO ORAL STATEMENT BY AN INSPECTOR MODIFIES THESE TERMS.
SECTION 06Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO AN INSPECTION OR REPORT IS LIMITED TO THE FEE PAID FOR THAT INSPECTION. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING REPAIR COSTS, PROPERTY DAMAGE, LOST PROFITS, OR DIMINUTION IN PROPERTY VALUE. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
SECTION 07Client Responsibilities
- Review the full report and video before making decisions that rely on them.
- Direct questions about findings to us before closing or beginning repairs.
- Obtain repair estimates from licensed contractors; our report is not a repair quote.
SECTION 08Website Use
You agree not to misuse the website — including attempting to disrupt it, scrape it by automated means, or use it to violate any law. Website content, branding, and report formats are owned by ClearPass or its licensors and may not be copied for commercial use without permission.
SECTION 09Indemnification
You agree to indemnify and hold us harmless from claims arising out of your breach of these Terms, your misrepresentation of authority to grant property access, or your unlawful use of the Services.
SECTION 10Governing Law and Disputes
These Terms are governed by the laws of the State of Ohio, without regard to conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in Cuyahoga County, Ohio, and you consent to their jurisdiction.
SECTION 11Changes to These Terms
We may update these Terms from time to time. The "Last updated" date above reflects the latest revision. Material changes will be posted on this page before they take effect. Continued use of the Services after the effective date constitutes acceptance.
